Terms of Use for FindX

The goal of these Terms of Use (hereinafter referred to as "Rules") is to link independent professionals with brands and employers globally, increasing employment opportunities through portfolio showcasing. FindX offers services to foster economic opportunities for members, enabling connections and employment discovery within a trusted network.

The Rules apply to FINDX and all the websites and apps we own or run. (And by we, we mean WHIZZGROUP and our affliates, which we may also refer to as us .)

This is an agreement between you (user or member) and FindX. Please read these Rules, FindX Privacy Policy, and the other applicable rules, policies, and terms available at the www.findx.io, (collectively, "Agreement") before using the FindXApplication. By using FindX, you agree to be bound by the terms of the Agreement. If you do not accept the terms of the Agreement, then you may not use FindX.

Your use of any of the FindX Services is subject to any additional rules, policies, and terms that apply to those FindX Services. These terms explain how we expect you to behave when you're using FindX – whether you're a registered user or unregistered site visitor on our Application/Website.

Please read these Rules carefully: by using our Application, you're agreeing to follow them.

1. Agreement to Terms

  • By clicking "Join Now, " "Sign Up, " or similar actions, registering, accessing, using our application or website (collectively referred to as "Services"), you agree to enter into a legally binding agreement with FindX. If you do not agree to these Terms of Use ("Rules"), please do not access or use our Services.
  • We may modify these Rules, our Privacy Policy and any other related policies from time to time. If any material changes are made then you shall be notified of the same, to provide you the opportunity to review the changes before they become effective. Your continued use of our Services after any modifications to these Rules signifies your acceptance of the changes as of their effective date.

2. Services

These Terms apply to all services provided by FindX, including our website, mobile applications and any related sites or services that reference these Terms. We may also offer additional features or tools, which may be governed by their own specific terms.

3. User Categories

  • Members: Individuals who register and create an account to access additional features and services on our application.
  • Visitors: Individuals who use certain features of our Services without registering. While Visitors can access some content, Members will have access to a broader range of functionalities.

4. Eligibility

  • You are at least 18 years old.
  • you will only maintain one account, and it must reflect your identity proof name.
  • You are not currently restricted from using our Services for any reason, including prior violations of these Rules.

5. Account Responsibilities

As a Member, you agree to :

  • Keep Your Password Confidential : You are responsible for maintaining the confidentiality of your password and account information. Do not share your login details with anyone.
  • Not Share Your Account :Your account is personal to you, and sharing it is a violation of these Rules.
  • Report misuse :It is your responsibility to report any misuse of your account to us. Unless such misuse is reported, you are responsible for anything that happens through your account.

6. Payment Obligations

If you choose to enter into a service with another party through FindX then you are obligated to :

  • Pay Fees : Client is responsible for paying all applicable fees and taxes related to the Services he/she avails through the Service Provider.
  • Authorize Payments: Parties authorize FindX to store their payment information and automatically charge your payment method as necessary for ongoing subscription fees or future purchases.
  • Understand Fee Changes :
    a. We may modify our fees and will provide reasonable notice of any changes.
    b. Failure to pay subscription fees or the fee to the Service Provider for the Services may result in suspension or termination of the account of the Client.

7. Notices

You agree that FindX may send you notices, messages, or other communications regarding your account and our Services through :

  • In-Service Messaging : Notifications within the platform.
  • Contact Information : Email, phone, or postal mail based on the information you provided during registration (which shall be a confidential and only available with us). It is your responsibility to keep this information updated.

8. Content Sharing

When you share content through FindX, you acknowledge that :

  • Visibility : Your shared content may be viewed by other Members and Visitors and can be re-shared or copied by them.
  • Discretion : FindX has the discretion to remove any content at any time without notice.
  • Attribution : We will respect your content-sharing settings and will not use your content in third-party advertising without your consent.

9. Responsibility

Anyone else who uses our site is responsible for what they post or link on FindX .

We're not responsible for the accuracy or reliability of any content shared by other people on our site, unless they're offcially working for us when they share or post the content. Any content represents the person sharing it, not FindX.

Our site might also contain links or other access to third-party websites and applications. These sites and applications are owned and run by other parties, not FindX. If we use a link or application that goes to a third-party website, it doesn't mean that we endorse it and you agree that you use it without our endorsement

10. Intellectual Property

You retain ownership of the content you provide to FindX. However, by sharing content, you grant us a non-exclusive, worldwide, transferable license to :

  • Use Your Content : This includes the rights to copy, modify, distribute, and publicly display your content.
  • Consent for Ads: We will not use your content for third-party advertisements without your explicit consent, though we may display ads alongside your content in accordance with our Privacy Policy.

11. Indemnification

You're responsible for how you use our site and anything you post on it. If someone makes a claim against us because of anything you put on the site, you agree to compensate us for our legal fees and expenses (hereinafter referred to as 'Indemnification').

When you post content on (or through) our application, you agree that you're completely responsible for that content. You also agree to only post or give us content that :

  • you have the right to post
  • is legal
  • doesn't violate anyone's rights, including intellectual property rights.

You acknowledge and agree that whoever posts content is responsible for any harm caused to anyone by that content – not FindX – and that you'll compensate and defend us, our partners, employees and representatives against any costs or legal or government action we have because of your content.

12. Termination

Both you and FINDX have the right to terminate this agreement. Upon termination :

  • Loss of Access :You will lose your access to our mobile application.
  • Survival of Rights : Certain rights and obligations, including those related to messaging and content shared, will survive termination.
  • Account Closure : You can close your account at any time via your account settings

13. Governing Law

This agreement is governed by the laws of India. For users in different locations, any disputes will be resolved in the appropriate courts in Mumbai, India.

14. General Terms

  • Severability : If any provision of these Rules is found to be unenforceable, the remaining provisions will remain in full effect.
  • Entire Agreement : These Rules represent the complete agreement between you and FindX regarding the Services and supersede any previous agreements
  • Waiver : FindX's failure to enforce any right or provision of these Rules does not constitute a waiver of that right or provision.

15. Community Guidelines

1. Do's
As a user of our Services, you agree to :

  • Comply with Laws : Abide by all applicable laws, including privacy, intellectual property, and anti-spam laws.
  • Provide Accurate Information :Ensure that the information you provide is true, accurate, and kept up to date.
  • Use Your Real Name : Maintain a professional identity on your profile.
  • Act Professionally : Engage with others in a respectful and constructive manner and don't post unacceptable or obscene content.

2. Don'ts
You agree not to :

  • Create False Identities : Misrepresent your identity or create profiles for others.
  • Use Automated Tools : Employ automated means to access our Services or scrape data.
  • Share Unauthorized Content : Disclose information that you do not have the right to share, including confidential information.
  • Infringe on Rights : Violate the intellectual property rights of others, including copying content without permission.
  • Post Harmful Content : Upload viruses or other harmful code that could disrupt our Services.
  • Engage in Misleading Practices : Imply any affliation or endorsement by FindX without our consent.

16. Complaints

If you believe that any content posted by our Members violates your rights, please contact us at connect@findx.io. We take such complaints seriously and will investigate accordingly.
